This Appropriate Use Policy ("AUP") describes the rules and restrictions that apply when using the services of Proxy-Cheap (the "Provider"). It applies to all usage of the Provider’s services and infrastructure.Because proxy servers can be used in many different ways, this AUP is intended as a guideline and cannot cover every possible scenario. The examples listed below are representative forms of misuse and do not limit Provider’s right to act in other similar cases.Prohibited activitiesThe following activities are strictly prohibited when using Provider’s services. Violations may result in immediate suspension or termination of access, without refund.1. Copyright and intellectual property infringementYou must not use the services to infringe copyrights, patents, trademarks, or other intellectual property or proprietary rights of third parties under any applicable law.2. SpammingYou must not send or assist in sending unsolicited bulk messages or spam of any kind through the services, including but not limited to email spam, social network spam, blog or comment spam, or forum spam.3. Illegal activitiesYou may not use the services for unlawful purposes, including but not limited to threats of violence, promotion of terrorism, fraud, identity theft, privacy violations, racketeering, or defamation.4. Child sexual abuse materialAny activity involving exploitation of children or child sexual abuse material is strictly forbidden, including viewing, distributing, promoting, or facilitating such content. The Provider will cooperate with applicable authorities as required by law.5. Threats and harassmentYou must not use the services to threaten, harass, or intimidate any person, business, or organization.6. Fraud and deceptive conductYou must not use the services for fraudulent purposes, including creation or use of fake identities, accounts, or payment information.7. Denial of service attacksYou must not initiate, control, or participate in denial-of-service or distributed denial-of-service attacks or any similar activity that disrupts other networks or systems.8. Hacking and unauthorized accessYou must not attempt to gain unauthorized access to systems, networks, devices, or data, whether belonging to Provider or any third party.9. Malware distributionYou must not create, distribute, or use malware such as viruses, trojans, rootkits, spyware, keyloggers, password crackers, or similar tools designed for malicious use.10. Phishing and credential theftYou must not operate phishing sites or services, or attempt to collect sensitive personal information (including account names, passwords, payment data, or similar information) in a deceptive or unauthorized way.11. Fraudulent financial and Ponzi schemesYou must not use the services to promote, offer, or run illegal investment programs, Ponzi schemes, or other fraudulent financial arrangements.12. BullyingYou must not use the services to bully or systematically abuse any individual, group, or organization.13. StalkingYou must not use the services to stalk or otherwise track individuals in an abusive or intrusive manner.14. Derogatory or abusive conductYou must not engage in behavior, or publish content, that is intentionally malicious, demeaning, hateful, or defamatory towards others.15. ImpersonationYou must not impersonate any person (living or deceased) or organization, or falsely claim to represent any entity.16. Reports from third partiesThe Provider may investigate reports from third parties alleging violations of this AUP. After review, the Provider may, at its sole discretion, take any action it considers appropriate, including suspension or termination of services.17. Compliance with lawYou must not use the services in any way that violates applicable laws or regulations, whether civil or criminal, and whether local, national, or international.18. Access to restricted websitesThe Provider may block access to certain websites or services. You agree not to attempt to access such destinations through the Provider’s services.19. Use of prohibited softwareYou agree not to use software or tools that the Provider has identified as incompatible or prohibited in connection with its services.Customer definition and responsibilityFor the purposes of this AUP, “Customer” refers to the person or entity identified as the user in the applicable Terms of Service, including any authorized or unauthorized party that gains access through Customer’s account or credentials.Handling of alleged violationsIf the Provider becomes aware of a potential violation of this AUP, it may notify the Customer and request a response within a specified timeframe. If the Customer does not respond or if the Provider determines that a violation has occurred, the Provider may suspend or terminate services at its sole discretion, without refund or credit.Security, monitoring and legal disclosuresWhile the Provider takes reasonable steps to protect systems and data, it cannot guarantee that Customer information or traffic will never be accessed without authorization. Customer agrees that the Provider is not liable for unauthorized access to Customer data arising from factors beyond its reasonable control.The Provider may monitor use of its services, including traffic patterns and access logs, in order to enforce this AUP, protect its rights, and comply with applicable legal obligations.The Provider may be legally required to disclose Customer information in response to a valid subpoena, court order, or request from an authorized government agency. Where permitted by law, the Provider may, but is not obligated to, notify Customer of such requests.Data collection and retentionThe Provider may maintain logs and other records relating to use of its services, including information about visited websites and payment-related data. Such information is retained for a limited period and may be kept longer if necessary, at the Provider’s discretion.Right to refuse or discontinue serviceThe Provider reserves the right, in its sole discretion, to refuse new service, decline renewals, or discontinue existing services for any Customer, including those suspected of violating this AUP or the Terms of Service.Changes, relationship to Terms of Service, and severabilityThis AUP forms part of, and is incorporated into, the Provider’s Terms of Service. Any breach of this AUP is considered a breach of the Terms of Service and may result in immediate termination of services.The Provider may update this AUP at any time. Customers are responsible for checking the current version published on the Provider’s website. Continued use of the services after changes are posted constitutes acceptance of the updated AUP.If any provision of this AUP is found to be invalid or unenforceable, the remaining provisions remain in full force.
